Terms of Service

1. Acceptance of Terms

By accessing or using takyo.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

Takyo provides a dashboard platform for competitive streamers, including leaderboard tracking, giveaway management, Discord and Kick integrations, anti-snipe protection, and related tools. Features vary by subscription plan.

3. Account Registration

  • You must sign in using a valid Discord account.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years of age to use the Service.
  • You agree to provide accurate and complete information and to keep your account information up to date.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

  • Paid plans are billed monthly on a recurring basis through Stripe.
  • All prices are listed in US Dollars (USD) and are subject to change with prior notice.
  • You may upgrade, downgrade, or cancel your subscription at any time from your Settings page.
  • Cancellation takes effect immediately. There is no prorated refund for partial billing periods unless covered by our Refund Policy.
  • Failed payments may result in suspension of your account until payment is resolved.

5. Donations

Donations made through the Service are voluntary contributions to support development. Donations are not payments for goods or services. Donors receive a verified badge on their profile as a token of appreciation. Donations are non-refundable unless otherwise stated in our Refund Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Use bots, scrapers, or automated tools to access the Service without authorization
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use the Service to conduct or facilitate gambling where prohibited by law
  • Share, resell, or redistribute your account access or subscription

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, code, and software — are owned by Takyo and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Third-Party Services

The Service integrates with third-party platforms including Discord, Kick, Stripe, and various gambling platforms for leaderboard tracking. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the accuracy or reliability of any content or data provided through the Service.

10. Limitation of Liability

To the fullest extent permitted by law, Takyo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time from the Settings page.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unsuccessful, through binding arbitration or in the courts of competent jurisdiction.
